Reputed MS-13 Gang Members Charged in Fatal Shooting on Jackson Heights Subway Platform

Two additional men—who were being sought for the beating and shooting of a man killed on a subway platform—have been charged with murder and other crimes for the Sunday, Feb. 3 incident, Queens District Attorney Richard Brown announced on Friday.
Victor Lopez, 20, and Tito Martinez-Alvarenga, 19, both of Flushing, are alleged members of the violent MS-13 street gang. They were arraigned on Friday on a complaint charging them with second-degree murder, first-degree gang assault, first-degree kidnapping and second-degree criminal possession of a weapon. Lopez and Martinez-Alvarenga were remanded and ordered to return to court on March 8.
According to the criminal complaint, at approximately 12:45 p.m. on board a 7 train, Martinez-Alvarenga pointed a gun at Abel Mosso as his co-defendants struck the man. Moments later, Martinez-Alvarenga, Lopez and Ramiro Gutierrez, 26, allegedly pulled the 20-year-old victim from the train onto the 90th Street subway platform in Jackson Heights and continued to pummel the victim with punches and kicks.
Surveillance video of the incident allegedly shows the victim attempt to stand up, just as Gutierrez allegedly points a firearm in his direction, followed by the sounds of gunshots. The three defendants run from the platform. Mosso was pronounced dead at the scene.
“What started out as an alleged violent gang assault quickly turned into a heinous public slaying. The victim was killed during a brazen broad day light attack with dozens of fellow subway riders as witnesses. The two men—along with a third previously charged individual—are alleged to have pulled the victim from the train, rain punches and kicks on him before the man was shot several times in the head,” Brown said. “The defendants now face the possibility of being locked away for life.”
